Employers are not required by law to post job openings internally. It is, nevertheless, good practice to do so, and it may help in defending a discrimination claim if current workers are given full notice of the availability of a position so that they might apply. If a current employee believes that a lack of internal advertising was done to discourage them from applying, they may allege that this was done for grounds linked to sex, color, or handicap, or for another discriminatory cause.
