The duties of a magistrate

Volunteers from the community serve as magistrates, taking on the role of presiding judges in local courts. Cases may be brought before them in either the family court or the criminal court, or both.

In most cases, there are three magistrates who deliberate over each case. One of these judges is specially qualified to preside over the proceedings.

A legal advisor in the court is responsible for providing guidance on the law and ensuring that the magistrates adhere to the appropriate procedures.


Criminal cases

A magistrate's court is the first venue for any and all criminal matters.

The Crown Court hears the most severe cases, such as murder, rape, and robbery, once the Magistrates Court has sent them on. The magistrates make the decision as to whether the defendant should be:

held in captivity, for example in a cell provided by the police or the court

released only under stringent restrictions, such as a prohibition against approaching certain locations or individuals.


The following types of offences are handled by the Magistrates:

small assaults

violations of the law involving vehicles

theft

managing stolen property

TV licence evasion


The following are some examples of potential sentences handed out by magistrates:

penalties include community service without pay for a period of up to six months (or up to 12 months for more than 1 crime)

Family matters

In addition, matters brought before a family court may be heard by magistrates.


These judges hear situations involving minors, namely children. They may also:

Make the necessary arrangements for a child to be placed in foster care or adopted.

Assist divorced or separated parents in making child-rearing arrangements.

Make sure that child support orders are followed.

Create judicial orders to put an end to abuse in the home.

During the course of the case, these judges have the ability to seek counsel from the child's guardian or a family court advisor.
